1. Agreement to Terms

By accessing and using SmallBizWeb.ai ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Services Provided

SmallBizWeb.ai provides:

AI-powered website design preview generation
Professional website design and development services
Website deployment and hosting coordination
Website maintenance and support packages

3. AI Preview Tool

Our AI preview tool generates example website designs based on your prompts. These previews are for demonstration purposes only and do not represent final deliverables. Actual website designs will be developed through our paid services and may differ from AI-generated previews.

4. Subscription Service and Pricing

IMPORTANT: Our Complete Website Package is a subscription service with specific terms you must understand before purchasing:

Subscription Commitment

Yearly Commitment Required: By subscribing, you commit to maintaining your subscription for a minimum of ONE (1) YEAR from your purchase date.
Monthly Payment Option: $9.99 USD per month, billed monthly for 12 months. You must maintain active payment for the full year.
Annual Prepay Option: $99 USD paid upfront for the entire year (saves $20 compared to monthly payments).
What's Included: Professional website, hosting, security, support, and 10 monthly messages/changes to your website.

Automatic Renewal Terms

Your subscription AUTOMATICALLY RENEWS after your initial commitment period unless you cancel.
Monthly Subscribers: After your first year, your subscription continues at $9.99/month and will automatically renew each month until you cancel.
Annual Prepay Subscribers: After your first year, your subscription will automatically renew for another full year at $99 unless you cancel before your renewal date.
Renewal Notification: We will send you a reminder email 30 days before your annual renewal date.
Cancellation: After completing your first year, you may cancel anytime. Cancellations must be made at least 7 days before your next billing date to avoid being charged for the next period.

Payment Processing

All prices are in USD
All payments are processed securely through Stripe
You authorize us to charge your payment method automatically for recurring payments
Failed payments may result in service suspension after 7 days
Domain registration fees are separate and not included in our packages

5. Money Back Guarantee

We offer a money back guarantee on our Complete Website Package subscription. Terms:

If you are not satisfied with the initial website design concept, you may request a full refund within 14 days of your first draft delivery.
Refunds are not available after the website has been deployed to your domain.
Monthly subscribers who receive a refund will have their subscription cancelled and no further charges will be made.
Annual prepay subscribers who receive a refund will have their full payment refunded and subscription cancelled.
Refunds are only available for the initial website build, not for ongoing subscription fees after the website is live.

6. AI Website Builder Portal and Timeline

After purchasing your subscription, you will receive access to your personal AI Website Builder portal. The process works as follows:

Portal Access: Within 24 hours of purchase, you'll receive an email with your portal login credentials and setup instructions.
Website Generation: Complete the intake form in your portal about your business. Our AI will automatically generate your initial website design within minutes.
Initial Optimization: You receive 20 AI messages/prompts to optimize and refine your website before deployment. Use these to make changes in plain English (e.g., "Make the header blue" or "Add my business hours").
Self-Service Editing: All changes are made by you through the AI chat interface in your portal. Simply describe what you want changed, and the AI will update your website.
Deployment: When you're satisfied with your website, you can deploy it to your domain directly from your portal.
Timeline: Your website can be completed as quickly as you can work through the process. Most customers deploy within 1-7 days depending on how quickly they provide information and review changes.

7. AI Messages and Website Changes

Pre-Deployment (Initial Setup)

20 Initial Messages: Before you deploy your website for the first time, you receive 20 AI messages to optimize and perfect your design.
These messages allow you to make unlimited changes and refinements until you're completely satisfied.
Use these to customize colors, layouts, content, images, and any other aspect of your website.
If you use all 20 messages before deployment, additional message packs can be purchased separately.

Post-Deployment (Monthly Ongoing)

10 Messages Per Month: After deployment, your subscription includes 10 AI messages each month to update and maintain your website.
Use these messages to update content, change images, modify text, adjust layouts, or make other changes to your live website.
Messages DO NOT roll over - unused messages expire at the end of each monthly billing period.
Your message count resets to 10 at the beginning of each new billing period.
Additional message packs are available for purchase if you need more than 10 changes in a given month.

Important Notes About AI Messages

Each message represents one conversation with the AI to make changes to your website, regardless of how many individual edits are requested in that message.
The AI processes your requests and updates your website automatically - no manual coding or technical knowledge required.
Complex requests (major redesigns, new features, e-commerce functionality) may be outside the scope of included messages and could require additional services at additional cost.
We reserve the right to determine if a request exceeds the reasonable scope of the AI message system.

Purchasing Additional Messages

If you need more messages than your monthly allotment, you can purchase additional message packs:

Cost: $20 USD per pack (includes 10 additional AI messages)
Never Expire: Unlike your monthly included messages, purchased messages never expire and are not time-bound.
Rollover Month to Month: Purchased messages carry over to subsequent months until you use them all.
Used First: When you send a message, the system automatically uses your purchased messages first before using your monthly included messages.
Instant Activation: Purchased messages are added to your account immediately upon successful payment.
Non-Refundable: Once purchased, additional message packs are non-refundable, even if unused.
Survives Subscription Cancellation: If you cancel your subscription, any unused purchased messages are forfeited and cannot be transferred or refunded.

8. Intellectual Property

Upon full payment, you own the final website design and content created specifically for your project. We retain the right to showcase your website in our portfolio unless you request otherwise. Stock images, third-party integrations, and licensed components remain property of their respective owners.

9. Client Responsibilities

You agree to:

Provide necessary content, images, and information in a timely manner
Respond to communications within reasonable timeframes
Ensure you have rights to all content you provide
Purchase and maintain your own domain name (we can assist with setup)

10. Support and Technical Assistance

Your subscription includes email support for technical issues and questions about using your portal.

Email Support: We respond to all support inquiries within 24 hours during business days.
Portal Assistance: Help with accessing your portal, understanding features, and using the AI chat system.
Technical Issues: Assistance with website deployment, domain setup, and resolving technical problems.
Self-Service First: Most website changes and updates are made by you through the AI chat system in your portal using your included messages (see Section 7).
We do not make website changes on your behalf - all edits are done through your self-service portal using AI messages.

11. Limitation of Liability

SmallBizWeb.ai is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the specific service in question.

12. Cancellation and Termination

First Year Commitment

You cannot cancel your subscription during the first year except under the Money Back Guarantee terms (Section 5). By subscribing, you agree to pay for the full first year of service.

Monthly Subscribers: You are committed to 12 monthly payments of $9.99 each ($119.88 total).
Annual Prepay Subscribers: You are committed to the full $99 annual payment.
If you attempt to cancel payment methods or dispute charges during your commitment period, we reserve the right to pursue collection of owed fees and suspend your service.

After First Year

You may cancel your subscription anytime after completing your first year commitment by contacting us through your customer portal or via email.
Cancellations must be submitted at least 7 days before your next billing date to avoid being charged for the next period.
Upon cancellation, your website will remain accessible until the end of your current paid period, then will be taken offline.
No refunds are provided for partial months or unused portions of annual subscriptions after cancellation.
We reserve the right to terminate service immediately for violation of these terms, fraudulent activity, or non-payment.

13. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated to active clients. Continued use of our services after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms of Service are governed by the laws of the jurisdiction in which SmallBizWeb.ai operates. Any disputes shall be resolved through binding arbitration.
